TERMS OF USE

Definitions

In these terms, the following definitions apply:

  • Cooling-off period: The timeframe during which consumers may exercise their right to withdraw from a contract.
  • Consumer: An individual acting outside their trade, business, craft, or profession.
  • Day: A calendar day.
  • Digital content: Data created and supplied in digital format.
  • Ongoing contract: A contract covering regular delivery of goods, services, and/or digital content over a specified period.
  • Durable data carrier: Any tool (including email) that allows the consumer or Trader to store information received for future reference, for a period consistent with the information’s purpose, and to retain, copy, or reproduce that information unchanged.
  • Right of withdrawal: The consumer’s ability to end a distance contract during the cooling-off period.
  • Trader: A natural or legal person providing consumers with products, access to digital content, and/or services remotely.
  • Distance contract: A contract between a Trader and consumer formed through an organized system for remote sale of products, digital content, and/or services—using distance communication technologies in whole or in part—up to and including the contract’s conclusion.
  • Model withdrawal form: A standard European withdrawal form included in Appendix I to these terms. If the consumer has no right to withdraw, this appendix is not required.
  • Distance communication technology: Technology enabling agreement without the consumer and Trader being in the same place at the same time.

Applicability

These terms govern all offers made by the Trader and every distance contract formed between the Trader and the Consumer.

Before a distance contract is concluded, the consumer must be given access to these terms. If this is not reasonably feasible, the Trader will explain how the terms can be reviewed before the contract is formed and will provide them free of charge upon the consumer’s request, as soon as possible.

For electronically concluded contracts, despite the above, the terms may be made available electronically to the consumer before the contract is formed—allowing easy storage on a durable data carrier. If this isn’t possible, the Trader will indicate where the terms can be viewed electronically before the contract is concluded and will send them electronically or via another free method upon the consumer’s request.

If product- or service-specific terms apply alongside these general terms, the above rules apply equally. In case of conflicting terms, the consumer may rely on whichever terms are most favorable to them.

Article 4 – Offers

Each offer includes a comprehensive, precise description of the products, digital content, and/or services offered—detailed enough to let the consumer evaluate the offering effectively. Any images used must accurately represent the products, services, or digital content. Obvious errors or mistakes in the offer do not bind the Trader.

Every offer also outlines the rights and obligations tied to accepting it.

Contract Formation

Unless stated otherwise in paragraph 4, a contract is formed when the consumer accepts the offer and meets its specified conditions.

When the consumer accepts the offer electronically, the Trader will immediately send electronic confirmation of receipt. Until this confirmation is sent, the consumer may withdraw from the contract.

For electronically concluded contracts, the Trader will implement appropriate technical and organizational measures to secure data transmission and maintain a safe network environment. If electronic payment is available, the Trader will take suitable security steps.

Within legal limits, the Trader may verify the consumer’s ability to meet payment obligations and other factors relevant to responsibly forming the distance contract. If this review gives the Trader valid reasons to decline, they may reject the order or application with an explanation, or impose special conditions for fulfillment.

By the time the product, service, or digital content is delivered, the Trader will provide the consumer (in writing or via a format storable on a durable data carrier) with:

a. The address of the Trader’s office where complaints can be submitted;
b. Details on how to exercise the right of withdrawal (or a clear statement that this right does not apply);
c. Information about warranties and available after-sales support;
d. Prices (including all taxes and fees), delivery costs (if applicable), and payment, delivery, or performance methods;
e. Terms for terminating contracts lasting over a year or with no fixed end date;
f. A model withdrawal form (if the consumer has the right to withdraw).

For pre-ordered items, the above applies only to the first delivery.

Right of Withdrawal

For products:
Consumers can end the contract for product purchases within the 14-day cooling-off period by emailing [email protected], no explanation needed. The Trader may ask for reasons but cannot require them.

The cooling-off period starts:

  • For single products: The day after the consumer (or a third party other than the carrier) receives the item.
  • For multiple products in one order: The day the last product is received by the consumer or their designated third party. (Note: The Trader may specify that orders with staggered delivery dates cannot be withdrawn as a whole, provided this is clearly stated before ordering.)
  • For products delivered in batches or parts: The day the last batch or part is received.

Pricing

During the validity of promotional terms, product and/or service prices remain fixed—except for changes due to adjustments in goods and services tax rates. All quoted prices include VAT.

Delivery and Performance

The Trader will carefully process orders and assess service requests.

Delivery takes place at the address provided by the consumer when placing the order.

Accepted orders will be fulfilled promptly, with a maximum 30-day timeframe unless a different delivery date is agreed. If delivery is delayed, the order cannot be fulfilled, or only partially fulfilled, the consumer will be notified within 30 days of ordering. In such cases, the consumer may withdraw from the contract at no cost and claim compensation.

If the contract is terminated under the above, the Trader will immediately refund any amounts paid. Unless agreed otherwise, the Trader bears the risk of damage or loss until the product is delivered to the consumer or their pre-announced representative.

Complaint Handling

The Trader maintains an open complaint process and follows it for all disputes.

Complaints about contract performance must be submitted to the Trader clearly and completely, within a reasonable time after the consumer discovers the issue.

All complaints will be addressed within 14 days of receipt. If a longer review is needed, the Trader will acknowledge receipt within 14 days and specify when a detailed response can be expected.

Consumers must allow the Trader at least 4 weeks to resolve the complaint through mutual agreement. After this period, any unresolved issue becomes a dispute subject to formal resolution procedures.

Article 17 – Additional or Alternative Terms

Any additional or alternative terms to these general conditions must not disadvantage the consumer and must be documented in writing or on a durable data carrier accessible to the consumer.
